The importance of a valid Will

If you are married or in a civil partnership and do not make a current Will, then any existing Will remains valid which might not be what you want if it provides for your ex-partner.  If you do not have a Will then until you remarry your partner automatically will inherit your assets which might not be what you want.

On marriage any existing Will becomes void, this applies if you have been divorced or have never been married the result will be that your partner will inherit what you have left as if you had no Will.

The only way to make sure that you have peace of mind knowing that in the event of your death you have made provision for the care and maintained of children and or relatives, and that what you own goes to who you want it to is by making a Will.

You can also protect your well-being, finances and those who are dear to you by making a lasting power of attorney. This gives authority to people you trust to administer your finances and affairs if you become mentally or physically incapacitated in the future. This can be cancelled by you at any time if you are still of capacity, but cannot be entered into if you have lost capacity, so delay is not recommended.

Free Will Service to help raise funds for Cancer Research UK

free will service cancer reserach solicitor hindlecampbell There are terms and conditions applied to the scheme, your use of our Free Will Service is governed by the following Terms and Conditions.

  • You must be aged 18 or over to use the Service.
  • For mirror Wills only one person needs to be 18 or over.
  • There is no obligation on users of the Service to leave a gift to Cancer Research UK.
  • Users of the service are limited to 3 free Will writing consultations under this scheme. This includes new Wills and changes to existing Wills.
  • Cancer Research UK reserves the right to withdraw the Free Will Service.
  • We understand that you may want your gift to go towards research into a certain type of cancer or to provide support in your local area. We will endeavour to meet this wish as far as is reasonably possible.

Cancer Research UK pays for supporters to write a ‘simple’ Will, mirror Will, single Codicil or mirror Codicil, as this helps to drive income from gifts in Wills by removing the need for supporters to pay for their Will. Cancer Research UK does not pay for more complicated Wills as this would negatively impact the charity’s return on investment beyond its current desire.  If the costs of writing your Will exceed this fixed sum you are responsible for the additional amount. When giving instructions to your solicitor you should check that the cost of the Will is covered by the Free Will Service.

Please note your solicitor alone, not Cancer Research UK, has control of and is responsible for preparing your Will.

Legal Aid Funding

If you have obtained an injunction or in certain other cases where there is proof that you have been a victim of domestic abuse legal aid can be available to help you with divorce, financial matters and arrangements for children.

If you need to make an application for an order that a child lives with you and this is supported by social services legal aid can be available to help you with the legal costs.

If social services are involved with your child and decide to make an application to court to potentially remove your child from your care you are automatically entitled to legal aid to instruct a specialist lawyer to represent you throughout the proceedings free of charge regardless of your income. Our solicitors who are members of the Law Society Children Panel specialise in helping parents at this very difficult time.

Sometimes, social services may ask you to attend a meeting about your children. These meetings are very serious legal meetings called “PLO Meetings”. PLO stands for Public Law Outline. You will receive a letter saying:

“LAST OPPORTUNITY TO STOP YOUR CHILDREN BEING REMOVED FROM YOUR CARE”

You must bring this letter with you and you will be seen urgently by one of our family lawyers. You will be entitled to free representation regardless of your income. Our lawyer will reassure you and make arrangements to attend the meeting with you.
